Decoration contract signing instructions

According to the “Residential House Decoration Management Measures” stipulations, the fitter and decoration companies should sign a written contract for the residential interior decoration and decoration, clarifying the rights and obligations of both parties.

Question: Is there any legal effect for verbal contractual decoration?

Answer: Oral agreement of the decoration contract, can not be concluded because the written contract does not consider the oral contract has no legal effect.

As for the part of the oral contract that is not stipulated or is not clarified, the decoration quality can be identified by the home decoration industry association according to the general industry standards, so as to determine the part of the rights and obligations that are not clearly or agreed upon by the parties.

Legal basis:

According to the "Contract Law of the People's Republic of China," parties sign contracts that can be either verbal or written. Oral contracts and written contracts have the same legal effect.

Question: What caused the loss due to the quality of the renovation?

Answer: According to "The People's Republic of China Contract Law", if one of the parties fails to perform its contractual obligations or fails to comply with the contractual obligations, it shall bear the liabilities for breach of contract such as continued performance, remedial measures, or compensation for losses.

Then during the renovation process, because the decoration person and the decoration company signed the “Renovation Contract”, the responsibility shall be based on the contractual agreement. If the contractual agreement is not clear or there is no agreement, the responsibility shall be determined based on the “Contract Law” and “General Principles of Civil Law”. The principles define the rights and obligations of both parties.

Question: The decoration has not been completed in accordance with the agreed time, the decoration company should compensate the owner for losses?

Answer: According to the "Contract Law of the People's Republic of China", the parties shall fully perform their obligations in accordance with the terms of the agreement. Then, if the decoration company fails to complete the project within the agreed time, it shall bear the liability for breach of contract. The way of assuming responsibility shall be based on the stipulations of the contract, and the contract does not stipulate that it shall be dealt with in accordance with the provisions of the law.
